1. Acceptance of these terms
These Terms of Use (“Terms”) govern your use of the UNCUFF the Innocent website and the services offered through it. By accessing or using the website, or by submitting information to us, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the website.
2. About UNCUFF and no legal advice
UNCUFF the Innocent is a nonprofit organization that works to overturn wrongful convictions. Nothing on this website is legal advice, and using this website or contacting us does not create an attorney-client relationship. Information provided on the site is general in nature and should not be relied upon as a substitute for advice from a licensed attorney about your specific situation. UNCUFF is not a law firm and does not represent you merely because it reviews, investigates, discusses, or provides financial support for a case. An attorney-client relationship exists only if a licensed attorney separately agrees in writing to provide representation.
3. Eligibility
The website and our programs are intended for adults. You must be at least 18 years old to apply to volunteer, and you must be able to form a binding agreement to use interactive features of the site.
4. Requests for aid
When new-case intake is open, you may submit a request for aid or information about a case. Submitting a request does not create any attorney-client relationship, does not guarantee that we will review, accept, or act on the case, and does not obligate us to provide any assistance. We accept only a limited number of cases, may pause new intake at any time, and use our sole discretion in deciding which matters to pursue. Do not rely on us to take any action, meet any deadline, or preserve any legal right in your matter.
5. Volunteering
Volunteer applications are reviewed at our discretion, and submitting an application does not guarantee a volunteer role. Approved applicants may be asked to complete an interview. Certain volunteer roles may require a background check. If one is required, we will provide a separate disclosure, obtain any required authorization, and follow applicable federal and state law. Volunteer roles are unpaid. Accepted volunteers must comply with separate confidentiality, data-security, and case-handling requirements before receiving access to nonpublic materials.
6. Donations
UNCUFF the Innocent (formerly Unite Nationwide for Cops Under Fire Foundation) is a 501(c)(3) nonprofit organization (EIN 82-3208410), and contributions are tax-deductible to the extent allowed by law. Donations are processed by a third-party payment provider subject to its own terms. Unless UNCUFF expressly accepts a restriction in writing, donations are unrestricted charitable contributions supporting UNCUFF’s overall mission. References to particular recipients, cases, projects, or examples do not restrict a donation to that matter. The board retains discretion to allocate funds among lawful organizational purposes. Recurring donations continue at the selected interval until canceled. Donors may cancel through the payment provider or by contacting UNCUFF. Cancellation does not ordinarily refund contributions already processed. Unless required by law, donations are non-refundable; if you believe a donation was made in error, contact us and we will work with you in good faith.
7. Your submissions
When you send us information through the website, you represent that you have the right to share it and that it is accurate to the best of your knowledge. By submitting information, you give UNCUFF permission to receive, copy, store, review, and share it internally and with authorized professionals and service providers for the purpose of evaluating your communication and carrying out our work. Submission does not authorize UNCUFF to publicly identify you, publish your private materials, or use your name, image, or personal story in fundraising or publicity unless we obtain separate permission or the information is already lawfully public. You represent that you are legally permitted to provide the information and that doing so does not violate a protective order, sealing order, confidentiality obligation, privilege, copyright, privacy right, or other legal restriction. This is consistent with our Privacy Policy. Please do not submit information that is unlawful, that infringes someone else’s rights, or that you are not permitted to share.
8. Acceptable use
You agree not to misuse the website. Among other things, you will not: use the site for any unlawful purpose; attempt to gain unauthorized access to the site or its systems; interfere with or disrupt the site; upload malicious code; harass, threaten, or defame others; or misrepresent your identity or affiliation.
9. Intellectual property
Except for materials identified as belonging to third parties, in the public domain, or reproduced under an applicable legal exception, the original text, graphics, logos, and design created for this website are owned by or licensed to UNCUFF the Innocent. Third-party materials remain subject to the rights and restrictions applicable to those materials. Nothing in these Terms limits rights provided by law, including fair use. We grant you a limited, personal, non-commercial license to view the site. You may not copy, reproduce, distribute, or create derivative works from our original content without our prior written permission, except as allowed by law.
10. Case content and corrections
Case pages contain UNCUFF’s analysis, conclusions, and advocacy positions based on records available to us as of the page’s publication or revision date. They are not complete reproductions of the trial or post-conviction record, and they do not replace official court records. A conviction, judgment, or official finding remains in effect unless the page expressly states otherwise.
We welcome specific correction requests. A request should identify the exact statement at issue and include or identify the records supporting the requested correction. 11. Disclaimers
The website and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free, or that any information on it is complete or current. We make no guarantee regarding the outcome of any case, request, or application.
12. Limitation of liability
To the fullest extent permitted by law, UNCUFF the Innocent and its directors, officers, volunteers, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of, or inability to use, the website or any information on it. Nothing in these Terms limits liability that cannot be limited under applicable law.
13. Governing law
These Terms are governed by the laws of the State of Iowa, without regard to its conflict-of-laws rules. Any dispute relating to the website or these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Iowa, to the extent permitted by law.
14. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the website after changes take effect means you accept the revised Terms.
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect.
